HOUSE BILL No. 4305

March 5, 2015, Introduced by Reps. Lucido, Poleski, Somerville, Tedder, Glenn, Geiss, McCready and Forlini and referred to the Committee on Families, Children, and Seniors.

 

     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 2849.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2849. (1) On a monthly basis, the state registrar shall

 

forward a notice of death of all individuals for whom the state

 

registrar received death notifications during that month to each

 

state department or agency that provides any type of public

 

assistance in this state.

 

     (2) The state registrar shall cooperate with any other

 

federal, state, or local governmental entity to provide for the

 

transfer of information regarding death registrations received

 

under this act for the purpose of ensuring that no claim for public

 

assistance under the laws of the United States, this state, or a

 

local governmental entity is being made either by an individual

 

purporting to be the decedent or by any other person on behalf of

 

the decedent.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 4306 (request no.

 

00216'15 a) of the 98th Legislature is enacted into law.
