A bill to amend 2000 PA 219, entitled
"Children's product safety act,"
by amending the title and section 25 (MCL 722.1075) and by adding
section 4.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
TITLE
An act to prohibit the manufacture, sale, or use of certain
unsafe children's products; to prohibit child care facilities from
using or having on the facility premises certain unsafe children's
products; to prescribe powers and duties of certain departments,
officers, and agencies; to provide for the promulgation of rules to
carry out the provisions of this act; and to prescribe penalties
for violation of the provisions of this act.
Sec. 4. (1) A person shall not manufacture a children's
product that is designed or intended to come in contact with a
child 7 years of age or younger and that contains a detectable
amount of bisphenol A.
(2) A person shall not sell a children's product that is
designed or intended to come in contact with a child 7 years of age
or younger if the person knows or has reason to know that it
contains a detectable amount of bisphenol A.
Sec. 25. (1) A person who violates section 4 is guilty of a
misdemeanor punishable by imprisonment for not more than 90 days or
a fine of not more than $100.00 for each item manufactured or sold
in violation of section 4, or both imprisonment and a fine.
(2) A commercial user who willfully and knowingly violates
section 5 is guilty of a misdemeanor punishable by a fine of not
more than $100.00 or by imprisonment for not more than 90 days, or
both.
