HOUSE BILL No. 4645

 

April 30, 2013, Introduced by Reps. Darany, Knezek, Schmidt, Jacobsen, Lane and Dillon and referred to the Committee on Transportation and Infrastructure.

 

     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

by amending section 684 (MCL 257.684).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 684. (1) (a) Every vehicle upon a highway within of this

 

state at any time from a half hour after sunset to a half hour

 

before sunrise and at any other time when there is not sufficient

 

light to render clearly discernible persons and vehicles on the

 

highway at a distance of 500 feet ahead shall display lighted lamps

 

and illuminating devices as hereinafter respectively required in

 

this chapter for different classes of vehicles, subject to

 

exceptions with respect to except for parked vehicles as

 

hereinafter stated provided in this chapter.

 

     (2) When lighted lamps and illuminated devices are required by

 

law, no a vehicle shall not be operated upon any highway of this

 

state with only the parking lights illuminated on the front of the

 

vehicle.

 

     (3) (b) Whenever requirement is hereinafter declared as to the

 

distance from which certain lamps and devices shall render objects

 

visible or within which such lamps or devices shall be visible,

 

said provisions shall apply during the times stated in paragraph

 

(a) of this section Requirements of this chapter concerning the

 

distance from which lamps and devices shall render objects visible

 

or from which the lamps and devices shall be visible apply during

 

the period provided in subsection (1) upon a straight, level,

 

unlighted highway under normal atmospheric conditions unless a

 

different time or condition is expressly stated.

 

     (4) (c) Whenever requirement is hereinafter declared as to the

 

mounted height of lamps or devices, it shall mean Requirements of

 

this chapter concerning the mounted height of lamps and devices

 

shall be calculated from the center of such the lamp or device to

 

the level ground upon which the vehicle stands when such the

 

vehicle is without a load.

 

     (5) A motor vehicle in this state shall display lighted lamps

 

and illuminating devices at all times that the vehicle's windshield

 

wipers are deployed in a continuous fashion to clear rain, snow, or

 

other moisture from the windshield.

 

     (6) Except as provided in subsection (7), a person who

 

operates a motor vehicle in violation of this section is guilty of

 

a misdemeanor.

 

     (7) A person who operates a motor vehicle in violation of

 

subsection (5) is responsible for a civil infraction.
