HOUSE BILL No. 4802

 

April 21, 2009, Introduced by Reps. Kowall, Miller, Byrnes, Rick Jones, Barnett, Lori and Scripps and referred to the Committee on Agriculture.

 

     A bill to amend 1919 PA 339, entitled

 

"Dog law of 1919,"

 

by amending section 26 (MCL 287.286).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 26. Any person or police officer, violating or failing or

 

refusing to comply with any of the provisions of this act shall be

 

guilty of a misdemeanor and upon conviction shall pay a fine not

 

less than $10.00 nor more than $100.00, or shall be imprisoned in

 

the county jail for not exceeding 3 months, or both such fine and

 

imprisonment. Any person presenting a false claim, knowing it to be

 

false, or receiving any money on such false claim, shall be guilty

 

of a misdemeanor and upon conviction, shall pay a fine of not less

 

than $10.00 nor more than $100.00, or shall be imprisoned in the

 

county jail for not exceeding 3 months, or both such fine and

 


imprisonment.

 

     (1) A person or police officer who violates any of the

 

provisions of this act or who fails or refuses to comply with any

 

of the provisions of this act is guilty of a misdemeanor punishable

 

by imprisonment for not more than 90 days or a fine of not more

 

than $500.00, or both.

 

     (2) A person who knowingly presents a false claim or who

 

receives any money on a false claim is guilty of a misdemeanor

 

punishable by imprisonment for not more than 90 days or a fine of

 

not more than $500.00, or both.

 

     (3) All fines collected under the provisions of this act shall

 

be paid to the treasurer of the county to be credited to the

 

library fund of the county.
