HOUSE BILL No. 4823

 

June 12, 2013, Introduced by Rep. Heise and referred to the Committee on Local Government.

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

(MCL 600.101 to 600.9947) by adding section 608.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 608. If a charter township and a local government are

 

involved in a proposed annexation as provided in section 34 of the

 

charter township act, 1947 PA 359, MCL 42.34, and do not enter into

 

a contract for a conditional transfer of property as provided under

 

section 34(8) of the charter township act, 1947 PA 359, MCL 42.34,

 

the circuit court of the county in which the property subject to

 

annexation is located has jurisdiction over the proposed

 

annexation. Neither party is entitled to a jury determination of

 

any issue under this section. The circuit court shall make a

 

determination and issue a final order concerning the proposed

 

annexation.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No. ____ or House Bill No. 4822(request no.

 

03074'13) of the 97th Legislature is enacted into law.
