A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9947) by adding section 5830.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 5830. (1) For an action an individual brings against the
unemployment agency for the recovery of damages arising out of an
accusation of fraud the unemployment agency made between January 1,
2007 and December 31, 2016 in association with a claim for
unemployment benefits under the Michigan employment security act,
1936 (Ex Sess) PA 1, MCL 421.1 to 421.75, the cause of action
accrues on the date the individual received actual notice from the
unemployment agency of the accusation. Actual notice does not
include notice transmitted by electronic means.
(2) An action described in subsection (1) must be commenced
within 6 years after the cause of action accrues.
(3) As used in this section, "unemployment agency" means that
term as defined in section 3 of the Michigan employment security
act, 1936 (Ex Sess) PA 1, MCL 421.3.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
