HOUSE BILL NO. 5218
A bill to require certain reports be submitted to the Michigan public service commission; and to provide for the powers and duties of certain state and local governmental officers and entities.
the people of the state of michigan enact:
(a) "Commission" means the Michigan public service commission.
(b) "Utility" means that term as defined in section 6g of 1939 PA 3, MCL 460.6g.
Sec. 3. (1) Except as otherwise provided in subsection (2), beginning May 1, 2024, and by the first day of each month thereafter, a utility that submits any of the following report forms to the United States Energy Information Administration shall also submit a copy of each report form to the commission:
(a) EIA-782C: Monthly Report of Prime Supplier Sales of Petroleum Products Sold for Local Consumption.
(b) EIA-810: Monthly Refinery Report.
(c) EIA-815: Monthly Bulk Terminal and Blender Report.
(d) EIA-816: Monthly Natural Gas Liquids Report.
(2) The commission may develop and make available on its website report forms that are substantially similar to and include all of the same informational sections as the report forms listed under subsection (1). If the commission develops and makes available report forms under this subsection, a utility that is required to submit a report form under subsection (1) may submit either a report form developed under this subsection or a report form described under subsection (1).
(3) A report form submitted under this section is exempt from disclosure under the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246.
