HOUSE BILL NO. 5253
A bill to amend 1954 PA 116, entitled
"Michigan election law,"
(MCL 168.1 to 168.992) by adding section 946.
The people of the state of michigan enact:
Sec. 946. (1) This state or a department, agency, commission, or board of this state shall not accept from an individual or nongovernmental entity, either directly or indirectly, a gift of money or other consideration to be used for an election-related activity, for election-related equipment, or for any election-related staff.
(2) Except as otherwise provided in subsection (3), a county, city, or township shall not accept from an individual or nongovernmental entity, either directly or indirectly, a gift of money or other consideration to be used for an election-related activity, for election-related equipment, or for any election-related staff.
(3) The prohibition in subsection (2) does not apply to any of the following:
(a) A city or township for establishing and providing a suitable polling place location for each precinct located in that city or township as required under section 662.
(b) A city or township for establishing and providing an absent voter counting board location as provided under section 765a.
(c) A city or township for establishing and providing a combined absent voter counting board location as provided under section 764d(1)(a).
(d) A county for establishing and providing an absent voter counting board location as provided under section 764d(1)(c).
(4) As used in this section:
(a) "Election-related activity" includes, but is not limited to, voter registration, voter eligibility review, mailing of election materials, sharing of voter registration information, creation or dissemination of advertisements about an election, or recruiting and hiring precinct election inspectors.
(b) "Election-related equipment" includes, but is not limited to, tabulators, communication devices, signs, tents, and absent voter ballot drop boxes.
(c) "Election-related staff" includes, but is not limited to, clerk assistants and election inspectors.
