SUBSTITUTE FOR

 

HOUSE BILL NO. 5281

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1984 PA 431, entitled

 

"The management and budget act,"

 

(MCL 18.1101 to 18.1594) by adding section 257.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 257. (1) If the department conveys lands, the department

 

shall not reserve oil, gas, or mineral rights to the lands.

 

However, the conveyance must provide that, if the grantee or any

 

successor develops any oil, gas, or minerals found on, within, or

 

under the conveyed lands, the grantee or any successor shall pay

 

this state 1/2 of the gross revenue generated from the development

 

of the oil, gas, or minerals. A payment under this section must be

 

deposited in the general fund.

 

     (2) A conveyance by the department must reserve to this state

 

all aboriginal antiquities, including mounds, earthworks, forts,

 

burial and village sites, mines, or other relics lying on, within,

 

or under the lands, with power to this state and all others acting

 

under its authority to enter the lands for any purpose related to

 

exploring, excavating, and taking away the aboriginal antiquities.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
