HOUSE BILL No. 5357

Smiley, Townsend, Byrum, Darany, Bledsoe, Lipton, Slavens, Brunner, Segal, Kandrevas, Geiss, Tlaib, Hovey-Wright, Nathan, Durhal, Stallworth, Ananich, Lindberg, Switalski, Rutledge, Bauer, Liss, Barnett, Meadows, Cavanagh, McCann, Irwin, Hammel, Howze and Brown and referred to the Committee on Redistricting and Elections.

 

     A bill to amend 1976 PA 388, entitled

 

"Michigan campaign finance act,"

 

(MCL 169.201 to 169.282) by adding section 57a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 57a. (1) A candidate or person acting on behalf of a

 

candidate shall not solicit or accept a contribution in a facility

 

owned or leased by, or on behalf of, this state or a public body.

 

     (2) Subsection (1) does not apply to a contribution solicited

 

or accepted in any of the following:

 

     (a) A facility owned or leased by, or on behalf of, the state

 

or a public body if that facility is primarily used as a family

 

dwelling and is not used to conduct a fund-raising event.

 

     (b) A facility owned or leased by, or on behalf of, the state

 

or a public body if any candidate has an equal opportunity to use

 

the facility.

 

     (3) A person who violates this section is guilty of a

 

misdemeanor punishable by imprisonment for not more than 90 days or

 

a fine of not more than $1,000.00, or both.
