A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 410d.

the people of the state of michigan enact:

Sec. 410d. (1) An individual who is present in this state who is not lawfully present in the United States is guilty of a felony punishable by imprisonment for not more than 5 years, a fine of not more than $50,000.00, or both.

(2) As used in this section, "lawfully present" means being a citizen of the United States or an individual who has all appropriate government-issued documentation that provides for free and legal travel within the boundaries of the United States.
