HOUSE BILL No. 5533

 

 

February 8, 2018, Introduced by Reps. LaFave, Miller and Johnson and referred to the Committee on Elections and Ethics.

 

     A bill to amend 1954 PA 116, entitled

 

"Michigan election law,"

 

by amending sections 282, 286, 289, and 643 (MCL 168.282, 168.286,

 

168.289, and 168.643), section 643 as amended by 2003 PA 302; and

 

to repeal acts and parts of acts.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 282. At Until December 31, 2022, at its fall state

 

convention each political party may nominate 2 candidates for

 

membership on the board of regents of the University of Michigan, 2

 

candidates for membership on the board of trustees of Michigan

 

State University, and 2 candidates for membership on the board of

 

governors of Wayne State University. Beginning January 1, 2023, at

 

its fall state convention each political party may nominate 4

 

candidates for membership on the board of regents of the University

 


of Michigan, 4 candidates for membership on the board of trustees

 

of Michigan State University, and 4 candidates for membership on

 

the board of governors of Wayne State University. Nomination to

 

membership on the board of regents of the University of Michigan

 

shall occur in 1966 and every second year thereafter. Nomination to

 

the board of trustees of Michigan State University and to the board

 

of governors of Wayne State University shall occur in 1964 and

 

every second year thereafter.

 

     Sec. 286. (1) Two Except as otherwise provided in subsection

 

(2), 2 members of the board of regents of the University of

 

Michigan shall be elected at the general election in 1966 and in

 

every general election thereafter. Two Except as otherwise provided

 

in subsection (2), 2 members of the board of trustees of Michigan

 

State University and 2 members of the board of governors of Wayne

 

State University shall be elected at the general election in 1964

 

and in every general election thereafter.

 

     (2) Beginning at the general election in 2024 and in every

 

general election thereafter, 4 members of the board of regents of

 

the University of Michigan, 4 members of the board of trustees of

 

Michigan State University, and 4 members of the board of governors

 

of Wayne State University must be elected.

 

     Sec. 289. (1) Subject to subsection (2) and section 286a, the

 

term of office of members of the state board of education, the

 

board of regents of the University of Michigan, the board of

 

trustees of Michigan State University, and the board of governors

 

of Wayne State University shall be is 8 years and shall begin

 

begins at 12 noon on January 1 next following their election.


     (2) Beginning at the general election in 2020, the term of

 

office of members elected to the board of regents of the University

 

of Michigan, the board of trustees of Michigan State University,

 

and the board of governors of Wayne State University is 4 years and

 

begins at 12 noon on January 1 next following their election.

 

     (3) The terms of office of members of said the boards shall

 

continue until a successor is elected and qualified.

 

     Sec. 643. At the general election, the following officers

 

shall must be elected when if required by law:

 

     (a) Presidential electors.

 

     (b) In the state at large, a governor and a lieutenant

 

governor, a secretary of state, and an attorney general.

 

     (c) A United States senator.Senator.

 

     (d) In each congressional district, a representative

 

Representative in congress.Congress.

 

     (e) In each state senatorial district, a state senator.

 

     (f) In each state representative district, a representative in

 

the state legislature.

 

     (g) Justices of the supreme court.

 

     (h) Two members of the state board of education.

 

     (i) Two Until December 31, 2022, 2 regents of the University

 

of Michigan. Beginning January 1, 2023, 4 regents of the University

 

of Michigan.

 

     (j) Two Until December 31, 2022, 2 trustees of Michigan State

 

University. Beginning January 1, 2023, 4 trustees of Michigan State

 

University.

 

     (k) Two Until December 31, 2022, 2 governors of Wayne State


University. Beginning January 1, 2023, 4 governors of Wayne State

 

University.

 

     (l) In each county or district, judges of the court of

 

appeals, a judge or judges of the circuit court, a judge or judges

 

of probate, a judge or judges of the district court, a prosecuting

 

attorney, a sheriff, a treasurer, an auditor, a mine inspector, a

 

county road commissioner, a drain commissioner, a surveyor, and,

 

subject to section 200, a clerk and a register of deeds or a clerk

 

register.

 

     (m) Township officers.

 

     (n) Any other officers required by law to be elected at that

 

election.

 

     Enacting section 1. 1963 (2nd Ex Sess) PA 23, MCL 390.691 to

 

390.693, is repealed.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Joint Resolution ____ or House Joint Resolution EE

 

(request no. 05519'18) of the 99th Legislature becomes a part of

 

the state constitution of 1963 as provided in section 1 of article

 

XII of the state constitution of 1963.
