A bill to amend 1927 PA 175, entitled

"The code of criminal procedure,"

by amending section 5 of chapter III (MCL 763.5).

the people of the state of michigan enact:

CHAPTER III

Sec. 5. (1) No person shall An individual must not be held to answer on a second charge or indictment for any offense for which he has been or she was acquitted upon on the facts and merits of the former at trial. but such A previous acquittal may be pleaded or given in evidence by him in an individual to bar of any subsequent prosecution for the same offense.

(2) An individual who was charged for an offense by the United States and acquitted on the facts and merits at trial must not be subsequently charged and tried for the same offense by this state.
