A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 12425 (MCL 333.12425).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 12425. (1) The department shall enforce this part and
rules promulgated under this part.
(2) An authorized representative of the department may enter
upon the premises of an agricultural labor camp at reasonable times
to inspect and investigate the premises to ascertain whether the
camp operator is in compliance with this part and the rules
promulgated under this part.
(3) The department may utilize the services of other state
agencies and offices to assist in conducting investigations. The
department may use the services of a local health department to
inspect the premises before licensing the camp operator and to
conduct investigations under rules promulgated under this part. The
department may approve payments of $15.00 to local health
departments for each licensed agricultural labor camp.
(4) If the agricultural labor camp does not pass the initial
inspection for a full license under this part, the inspector shall
provide the applicant with a list of deficiencies and a ranking of
the critical nature of each deficiency. To obtain a second or
subsequent inspection, an applicant shall submit a nonrefundable
reinspection fee of $500.00 for each agricultural labor camp
location that did not pass the initial or subsequent inspection
under this part. Upon receipt of the reinspection fee, the
department or its authorized representative or designee under this
section shall schedule and complete the second or subsequent
inspection in a timely manner. Money received by the department
under this subsection shall be submitted to the treasurer for
deposit in the fund.
