     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding section 1238.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1238. (1) The board of a school district or intermediate

 

school district or board of directors of a public school academy

 

shall ensure that the school district, intermediate school

 

district, or public school academy adopts and implements a policy

 

that prohibits school officials from requiring or requesting an

 

employee to sign a nondisclosure agreement concerning the terms of

 

his or her employment.

 

     (2) The board of a school district or intermediate school

 

district or board of directors of a public school academy shall not

 

enter into a contract with any other person to provide personnel to

 

work at the school district, intermediate school district, or

 

public school academy unless the contract ensures that an employee

 

will not be required or requested to sign a nondisclosure agreement

 

concerning the terms of his or her employment.
