HOUSE BILL No. 5762

 

January 21, 2010, Introduced by Reps. Kandrevas, Meadows and Scripps and referred to the Committee on Agriculture.

 

     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 70a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 70a. (1) Except as otherwise provided in this section, a

 

person shall not own or possess a nonhuman primate in this state as

 

a pet. A person who violates this section is guilty of a

 

misdemeanor punishable by a fine of not less than $250.00 or more

 

than $1,000.00, and 1 or both of the following:

 

     (a) Imprisonment for not more than 93 days.

 

     (b) Community service for not more than 500 hours.

 

     (2) Subsection (1) does not apply to any of the following:

 

     (a) A zoo or primate sanctuary accredited by the association

 

of zoos and aquariums.

 


     (b) An institution accredited by the association for

 

assessment and accreditation of laboratory animal care.

 

     (c) A law enforcement officer in the course of his or her

 

employment as a law enforcement officer.

 

     (d) A veterinarian in the course of his or her occupation as a

 

veterinarian.

 

     (e) A permitting agency in the course of its business or

 

mission as a permitting agency.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
