A bill to amend 1976 PA 412, entitled
"An act to provide for the suppression of serious diseases among
bees; to prescribe certain powers and duties of the director of the
department of agriculture; and to repeal certain acts and parts of
acts,"
(MCL 286.801 to 286.821) by amending the title and by adding
section 3.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
TITLE
An act to provide for the suppression of serious diseases
among bees and other pollinators; to prescribe certain powers and
duties
of the director of the department of agriculture and rural
development and the department of natural resources; to create a
pollinator health advisory council and prescribe its powers and
duties; and to repeal certain acts and parts of
acts.
Sec. 3. (1) The pollinator health advisory council is created
within the department of natural resources.
(2) The council shall consist of the following 12 members:
(a) The director of the department of natural resources or his
or her designee, who shall serve as or select the chairperson of
the council.
(b) The director of the department of agriculture and rural
development or his or her designee.
(c) Ten members appointed by the director of the department of
natural resources as follows:
(i) One representing the interests of public universities.
(ii) One representing the interests of mosquito control.
(iii) Two representing the interests of units of local
government.
(iv) Two representing the interests of nongovernmental
conservation and environmental organizations.
(v) Two representing the interests of farmer and other
agricultural organizations.
(vi) One representing the interests of pesticide applicators.
(vii) One representing the interests of commercial beekeepers.
(3) The members first appointed to the council must be
appointed within 90 days after the effective date of the amendatory
act that added this section.
(4) A vacancy on the council may be filled at the discretion
of the director of the department of natural resources.
(5) The council shall advise the department of natural
resources on pollinator health and provide assistance to the
department of natural resources in implementing the protection plan
by completing the following activities:
(a) Generating reports of the following within 12 months of
the council's first meeting:
(i) A list of products, based on the best available research,
that are harmful to pollinators.
(ii) Pesticide use across this state and all industries.
(iii) A baseline of pollinator health.
(b) Recommending best management practices and changes to
management practices to improve pollinator health.
(c) Tracking overall pollinator health and changes to
pollinator health.
(6) The council shall provide the reports listed under
subsection (5) to the department of natural resources and to the
senate and house committees on agriculture and on natural
resources.
(7) The department of natural resources may coordinate with
the Michigan State University Extension in providing administrative
support for the council.
(8) As used in this section:
(a) "Council" means the pollinator health advisory council
created in this section.
(b) "Protection plan" means the department of natural
resources's pollinator protection plan.
(9) The council shall exist for a period of 4 years following
the effective date of the amendatory act that added this section.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
