A bill to require private entities that receive public funds
to post certain information on a publicly accessible website; to
require public entities to obtain a compliance statement before
transferring public funds to private entities; and to establish the
thresholds for applying posting and statement requirements to
transfers of public funds to private entities.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. (1) A nonpublic entity, whether for-profit or
nonprofit, that receives $1,000,000.00 or more in public funds
during a fiscal year shall post all of the following information
for that fiscal year on a website that is accessible by the public:
(a) Any union contracts it has entered into that are in force.
(b) Its certified financial statement.
(c) The dollar cost of the compensation and benefits
identified to each of its 10 most highly compensated employees or
officers.
(d) Any contract it enters into that has a value of $25,000.00
or more.
(2) A public entity in this state shall not transfer public
funds with a value of $100,000.00 or more to a nonpublic entity in
a fiscal year unless the nonpublic entity provides a written
statement that it will post information in compliance with
subsection (1) if the cumulative amount of public funds the
nonpublic entity receives from all public entities in this state
during a fiscal year exceeds $1,000,000.00.
(3) As used in this section, "public funds" means money or
property to which all of the following apply:
(a) It is a grant or other gratuitous transfer.
(b) It is received from this state, a unit of local government
of this state, or another public entity in this state that receives
its funding primarily from state or local government fees or taxes.
(c) It is not money or property the public entity transfers
under a contract in exchange for goods or services.
(d) It is not a loan that the recipient is bound to repay.
