HOUSE BILL NO. 6143
A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 17756a.
the people of the state of michigan enact:
Sec. 17756a. (1) Except as otherwise provided in this section, a pharmacy shall ensure that each individual to whom a prescription drug is dispensed is notified that a prescription reader is available to the individual on request. If an individual informs the pharmacy that the individual identifies as an individual who is blind, the pharmacy shall ensure that the individual is provided with a prescription reader that is appropriate to address the individual's visual impairment and is available to the individual for at least the duration of the individual's prescription.
(2) A pharmacy that provides a prescription reader shall ensure that the label on a prescription that is dispensed by the pharmacy is compatible with the prescription reader.
(3) This section does not apply to a pharmacy that is located in a health care facility in which the prescription drug is dispensed to a health professional for inpatient administration.
(4) The board may promulgate rules to implement this section.
(5) As used in this section:
(a) "Individual who is blind" means an individual who meets any of the following:
(i) The individual is a blind person as that term is defined in section 1 of 1978 PA 260, MCL 393.351.
(ii) The individual is visually impaired.
(iii) The individual is print disabled.
(b) "Prescription reader" means a device that is designed to audibly convey the information contained on a label of a prescription drug.
