HOUSE BILL No. 6476

A bill to amend 1935 PA 59, entitled
"An act to provide for the public safety; to create the Michigan
state police, and provide for the organization thereof; to transfer
thereto the offices, duties and powers of the state fire marshal,
the state oil inspector, the department of the Michigan state
police as heretofore organized, and the department of public
safety; to create the office of commissioner of the Michigan state
police; to provide for an acting commissioner and for the
appointment of the officers and members of said department; to
prescribe their powers, duties, and immunities; to provide the
manner of fixing their compensation; to provide for their removal
from office; and to repeal Act No. 26 of the Public Acts of 1919,
being sections 556 to 562, inclusive, of the Compiled Laws of 1929,
and Act No. 123 of the Public Acts of 1921, as amended, being
sections 545 to 555, inclusive, of the Compiled Laws of 1929,"
by amending section 6c (MCL 28.6c), as amended by 2018 PA 5.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 6c. (1) The director may authorize, in writing, on forms
prescribed by the director or his or her designee, limited arrest
powers for security personnel employed by the state for the
protection of state owned or leased property and facilities.
Limited arrest authority may be exercised only when the security
employee is on a tour of duty as prescribed by the director upon
state owned or leased property and the person is identified by a
uniform as a state security employee. Limited arrest power is
automatically
rescinded upon on termination of employment with the
this state. The director may authorize security employees to carry
a firearm while on duty.
(2) A security employee granted limited arrest authority under
this section is not entitled by reason of employment to become a
member of a state police pension, accident, and disability plan
established under the state police retirement act of 1986, 1986 PA
182,
MCL 38.1601 to 38.1648, 38.1675,
or other similar departmental
program.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 6475 (request no.
05259'18) of the 99th Legislature is enacted into law.
