SENATE BILL No. 33

 

 

January 16, 2013, Introduced by Senator SCHUITMAKER and referred to the Committee on Local Government and Elections.

 

 

 

      A bill to amend 1976 PA 388, entitled

 

"Michigan campaign finance act,"

 

(MCL 169.201 to 169.282) by adding section 48.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 48. (1) An automated telephonic communication to an

 

 2  elector that relates to an election, a candidate, or ballot

 

 3  question shall clearly state the name of the person paying for

 

 4  the communication.

 

 5        (2) If the communication described in subsection (1) relates

 

 6  to a candidate and is an independent expenditure not authorized

 

 7  in writing by that candidate's candidate committee, the

 

 8  communication shall also clearly state the following disclaimer:

 

 9  "Not authorized by any candidate committee". If the communication

 

10  described in subsection (1) relates to a candidate and is not an

 

11  independent expenditure, but is paid for by a person other than

 


 1  the candidate to whom it is related, the communication shall also

 

 2  clearly state the following disclaimer:

  "Authorized by ___________________________________________".

           (name of candidate or name of candidate committee)

 

 

 5        (3) A communication described in subsection (1) shall

 

 6  clearly state the name of the person paying for the communication

 

 7  and any disclaimers required under subsection (2) at the

 

 8  beginning of the communication.

 

 9        (4) A person who knowingly violates this section is subject

 

10  to a civil fine of not more than $1,000.00 for each violation.
