SENATE BILL No. 60
January 27, 2009, Introduced by Senators JANSEN, KAHN, BIRKHOLZ, GILBERT and GARCIA and referred to the Committee on Commerce and Tourism.
A bill to amend 1969 PA 317, entitled
"Worker's disability compensation act of 1969,"
by amending section 209 (MCL 418.209), as added by 1985 PA 103.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
209. (1) The governor shall appoint a 6-member 10-member
qualifications advisory committee. Effective February 1, 2009, an
appointee to the qualifications advisory committee is subject to
the advice and consent of the senate. The committee shall consist
of
persons who have experience in the area of worker's workers'
compensation. Employer interests and employee interests shall be
equally represented on the committee.
(2)
Members shall be appointed for terms of 4 years. except
that
of the members first appointed, 2 shall be appointed for terms
of
2 years, 2 shall be appointed for terms of 3 years, and 2 shall
be
appointed for terms of 4 years. Of the 2 members appointed for
the
2-year, 3-year, and 4-year terms, 1 member representing
employer
interests and 1 member representing employee interests
shall
be appointed. A member shall not
serve beyond the expiration
of
his or her term. The initial members shall be appointed not
later
than October 1, 1985. A vacancy on the qualifications
advisory committee shall be filled by the governor so that employer
and employee interests continue to be equally represented on the
committee and shall be for the remainder of the unexpired term.
(3)
A quorum shall consist of 4 6
members. All business of the
committee shall be conducted by not less than a quorum. The
governor shall appoint a member of the committee to serve as the
committee's chairperson at the pleasure of the governor.
(4) Members of the qualifications advisory committee shall
serve
without compensation, but shall may
be reimbursed for all
necessary expenses in connection with the discharge of their
official duties as members of the committee, subject to available
appropriations.
(5) Staff and offices for the committee shall be provided by
the
bureau workers'
compensation agency.
(6) The committee shall have the powers and perform the duties
provided for under sections 210, 212, and 274.
