SENATE BILL No. 108

 

 

February 7, 2017, Introduced by Senators HUNE and WARREN and referred to the Committee on Agriculture.

 

 

     A bill to provide for the regulation of livestock raised in

 

urban and suburban areas; and to prescribe the powers and duties of

 

certain state and local agencies and officials.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "urban

 

agriculture act".

 

     Sec. 2. As used in this act:

 

     (a) "Advisory committee" means the urban livestock advisory

 

committee appointed under section 3.

 

     (b) "Commission" means the commission of agriculture and rural

 

development.

 

     (c) "Department" means the department of agriculture and rural

 

development.

 

     (d) "Livestock" means those species of animals used for human

 


food, fiber, and fur, or used for service to humans. Livestock

 

includes, but is not limited to, cattle, sheep, New World camelids,

 

goats, bison, privately owned cervids, ratites, swine, equines,

 

poultry, and rabbits. Livestock does not include dogs or cats.

 

     (e) "Local unit of government" means a county, township, city,

 

or village.

 

     (f) "Urban and suburban" means geographic areas where

 

residential, commercial, and industrial uses represent the primary

 

land uses.

 

     Sec. 3. (1) The commission shall appoint an urban livestock

 

advisory committee to advise it on the production of livestock in

 

urban and suburban areas. The advisory committee shall consist of

 

representatives from the state, local units of government,

 

academia, subject matter experts, and urban and suburban

 

agricultural producers. The commission shall make an effort to

 

appoint individuals who will provide a diverse representation of

 

race, gender, age, and geographic location throughout the state.

 

     (2) The advisory committee shall do all of the following:

 

     (a) Develop recommended guidelines related to raising

 

livestock in urban and suburban areas, including, but not limited

 

to, all of the following:

 

     (i) Soil sampling and evaluation.

 

     (ii) Livestock health.

 

     (iii) Livestock housing.

 

     (iv) Waste and manure management.

 

     (v) Livestock slaughter and euthanasia.

 

     (vi) Pest control.


     (b) Evaluate potential conflicts between livestock production

 

and residential uses in urban and suburban areas and potential

 

resolutions to those conflicts.

 

     (c) Make recommendations to the department on how it can

 

encourage and provide technical support for urban and suburban

 

livestock production.

 

     (d) Submit reports to the commission on the advisory

 

committee's findings and recommendations.

 

     (e) Review and make recommendations on the implementation of

 

this act and, at the request of the commission, review other

 

related topics.

 

     Sec. 4. (1) Upon receipt of the recommendations of the

 

advisory committee, the commission shall establish guidelines for

 

raising livestock in urban and suburban areas.

 

     (2) Beginning 5 years after the commission establishes

 

guidelines under subsection (1), and biennially thereafter, the

 

commission shall review the guidelines and modify the guidelines as

 

appropriate.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
