SENATE BILL No. 111

 

 

February 17, 2015, Introduced by Senators COLBECK, KNOLLENBERG, ROBERTSON, HANSEN, BRANDENBURG, PROOS, NOFS, EMMONS, PAVLOV and CASPERSON and referred to the Committee on Transportation.

 

 

 

     A bill to amend 1951 PA 51, entitled

 

"An act to provide for the classification of all public roads,

streets, and highways in this state, and for the revision of that

classification and for additions to and deletions from each

classification; to set up and establish the Michigan transportation

fund; to provide for the deposits in the Michigan transportation

fund of specific taxes on motor vehicles and motor vehicle fuels;

to provide for the allocation of funds from the Michigan

transportation fund and the use and administration of the fund for

transportation purposes; to promote safe and efficient travel for

motor vehicle drivers, bicyclists, pedestrians, and other legal

users of roads, streets, and highways; to set up and establish the

truck safety fund; to provide for the allocation of funds from the

truck safety fund and administration of the fund for truck safety

purposes; to set up and establish the Michigan truck safety

commission; to establish certain standards for road contracts for

certain businesses; to provide for the continuing review of

transportation needs within the state; to authorize the state

transportation commission, counties, cities, and villages to borrow

money, issue bonds, and make pledges of funds for transportation

purposes; to authorize counties to advance funds for the payment of

deficiencies necessary for the payment of bonds issued under this

act; to provide for the limitations, payment, retirement, and

security of the bonds and pledges; to provide for appropriations

and tax levies by counties and townships for county roads; to

authorize contributions by townships for county roads; to provide

for the establishment and administration of the state trunk line


fund, local bridge fund, comprehensive transportation fund, and

certain other funds; to provide for the deposits in the state trunk

line fund, critical bridge fund, comprehensive transportation fund,

and certain other funds of money raised by specific taxes and fees;

to provide for definitions of public transportation functions and

criteria; to define the purposes for which Michigan transportation

funds may be allocated; to provide for Michigan transportation fund

grants; to provide for review and approval of transportation

programs; to provide for submission of annual legislative requests

and reports; to provide for the establishment and functions of

certain advisory entities; to provide for conditions for grants; to

provide for the issuance of bonds and notes for transportation

purposes; to provide for the powers and duties of certain state and

local agencies and officials; to provide for the making of loans

for transportation purposes by the state transportation department

and for the receipt and repayment by local units and agencies of

those loans from certain specified sources; and to repeal acts and

parts of acts,"

 

(MCL 247.651 to 247.675) by adding section 11g.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 11g. (1) For each road or bridge project funded in whole

 

or in part by state revenue, the department shall, at a minimum,

 

provide all of the following information in the manner specified

 

under subsection (2):

 

     (a) Name of the road or bridge.

 

     (b) Description of the portion of the road or bridge that is

 

the subject of the project.

 

     (c) Cost of the project.

 

     (d) Funding sources and amounts for the project.

 

     (e) Number of lane miles applicable to the project.

 

     (f) Number of miles applicable to the project.

 

     (g) Required design life in years between reconstruction

 

projects, subject to the load profile described in subdivision (i).

 

     (h) The required interval between resurfacing projects,

 

subject to the load profile described in subdivision (i).

 

     (i) The load profile assumed for the required design life,


 

including, but not limited to, all of the following:

 

     (i) Number of trucks weighing less than 80,000 pounds per day.

 

     (ii) Number of trucks weighing 80,000 pounds or more per day.

 

     (iii) Number of passenger vehicles per day.

 

     (j) The method of design verification, including, but not

 

limited to, analysis, testing, or demonstration, that the design

 

will achieve the specified design life under the specified load

 

conditions.

 

     (k) The name of the individual designated as the project

 

manager.

 

     (l) The organization to which the project manager belongs.

 

     (m) The individual or organization responsible for the road or

 

bridge design.

 

     (n) The individual or organization responsible for design

 

verification.

 

     (o) The individual or organization responsible for road or

 

bridge construction.

 

     (p) The individual or organization responsible for certifying

 

that the road or bridge was built in accordance with the design

 

specifications.

 

     (q) The individual or organization responsible for certifying

 

that the construction materials used in the project satisfy design

 

specifications.

 

     (r) The date of completion of the road or bridge.

 

     (s) The current condition of the road or bridge.

 

     (2) The department shall annually make available the

 

information described in subsection (1) in the following manner:


 

     (a) Tab-delimited or Microsoft Excel-based format.

 

     (b) All data shall be contained in a single road construction

 

transparency data file featuring a unique column for each item

 

specified in subsection (1) and a single row for each project in

 

order to facilitate data analysis.

 

     (c) The department shall add the data for each road project to

 

the road construction transparency data file within 30 days after

 

the final acceptance of the completed road or bridge project.

 

     (d) The department shall update the current status of the road

 

or bridge condition column for each section of road or bridge at

 

least once every 2 years.

 

     (e) The department shall post the road construction data

 

transparency file online and shall make the road construction data

 

transparency file available for download by the general public.

 

     (f) If the department fails to comply with this subsection,

 

the individual designated as the project manager under subsection

 

(1)(k) shall report to the senate and house transportation

 

appropriations subcommittees at a hearing to be held no later than

 

60 days after final acceptance of the completed road or bridge

 

project. If the department posts the required information before

 

the hearing, the chairpersons of the senate and house

 

transportation appropriations subcommittees may cancel the hearing.

 

     (3) Each county road commission, city, and village shall

 

provide all of the information listed in subsection (1) to the

 

department for each road or bridge project of the county road

 

commission, city, or village that is funded in whole or in part by

 

funds from the department.


 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
