SENATE BILL No. 415
June 18, 2015, Introduced by Senator HANSEN and referred to the Committee on Transportation.
A bill to create the road and bridge fund; to provide for the
allocation of funds from the road and bridge fund; and to provide
for the powers and duties of certain state and local governmental
officers and entities.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act:
(a) "Department" means the state transportation department.
(b) "Fund" means the road and bridge fund created in section
3.
Sec. 3. (1) The road and bridge fund is created within the
state treasury.
(2) The state treasurer may receive money or other assets from
any source for deposit into the fund. The state treasurer shall
direct the investment of the fund. The state treasurer shall credit
to the fund interest and earnings from fund investments.
(3) Money in the fund at the close of the fiscal year shall
remain in the fund and shall not lapse to the general fund.
(4) The department shall be the administrator of the fund for
auditing purposes.
(5) Money in the fund shall be distributed as follows:
(a) 39.1% to the department. Money distributed to the
department under this subdivision shall be used by the department
in the same manner as provided in section 11 of 1951 PA 51, MCL
247.661.
(b) 39.1% to the county road commissions of this state. Money
distributed to a county road commission under this subdivision
shall be used by the county road commission in the same manner as
provided in section 12 of 1951 PA 51, MCL 247.662.
(c) 21.8% to the cities and villages of this state. Money
distributed to a city or village under this subdivision shall be
used by the city or village in the same manner as provided in
section 13 of 1951 PA 51, MCL 247.663.
Enacting section 1. This act takes effect 90 days after the
date it is enacted into law.
