SENATE BILL No. 423

 

 

June 30, 2015, Introduced by Senators STAMAS, KNEZEK, MACGREGOR and HORN and referred to the Committee on Agriculture.

 

 

 

     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

by amending section 2444 (MCL 333.2444).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2444. (1) A Subject to subsection (3), a local governing

 

entity, or in case of for a district the district board of health,

 

may fix establish and require the payment of fees for services

 

authorized or required to be performed by the local health

 

department. The Subject to subsection (3), the local governing

 

entity or district board of health may revoke, increase, or amend

 

the fees established under this subsection. The fees charged local

 

governing entity or district board of health shall not be establish

 

a fee under this section that is more than the reasonable cost of

 

performing the service.

 

     (2) Members of a local board of health may receive necessary


traveling expenses for attending meetings and may receive

 

compensation as determined by the local governing entity, or for a

 

district the district board of health, for each meeting attended.

 

     (3) Before January 1, 2018, for a food service establishment

 

license fee under the food law, 2000 PA 92, MCL 289.1101 to

 

289.8111, a local governing entity, or for a district the district

 

board of health, shall not charge a food service establishment

 

license fee under subsection (1) that exceeds the license fee in

 

effect on January 1, 2015. After December 31, 2017, the local

 

governing entity, or for a district the district board of health,

 

shall not charge a license fee described in this subsection that

 

exceeds the license fee for an extended retail food establishment

 

provided in section 4111(b) of the food law, 2000 PA 92, MCL

 

289.4111.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
