SENATE BILL No. 501
September 17, 2013, Introduced by Senators ANDERSON, HOPGOOD, ANANICH, JONES, BIEDA, JOHNSON, WHITMER, HUNTER, GREGORY, HOOD and YOUNG and referred to the Committee on Families, Seniors and Human Services.
A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 462k.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 462k. (1) A person who knows that another person is being
subjected to a violation of this chapter shall immediately report
that violation to a police agency. This subsection does not apply
if the person is not able to immediately report the violation
provided that he or she immediately reports the violation when able
to do so.
(2) The requirements for reporting a violation of this chapter
are met if either of the following applies:
(a) The person contacts a 9-1-1 emergency operator and reports
the violation.
(b) The person contacts the department of state police using
the toll-free number established by that department under the human
trafficking reporting act and reports the violation.
(3) The reporting requirements of this section include an
anonymous report if the person reports sufficient information to
identify the victim and nature of the offense.
(4) A person who violates this section is guilty of a
misdemeanor punishable by imprisonment for not more than 90 days or
a fine of not more than $500.00, or both.
(5) As used in this section, "police agency" means any of the
following entities having jurisdiction of the offense:
(a) The department of state police.
(b) A county sheriff's office.
(c) The police department of a village, city, or township.
(d) The police department of a community college, college, or
university.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No. 499
of the 97th Legislature is enacted into law.
