SENATE BILL No. 627

 

 

October 11, 2017, Introduced by Senator MARLEAU and referred to the Committee on Transportation.

 

 

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

by amending section 80105 (MCL 324.80105), as added by 1995 PA 58.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 80105. (1) This part applies to vessels and associated

 

equipment used, to be used, or carried in vessels used on waters

 

subject to the jurisdiction of this state.

 

     (2) This part, except where expressly indicated otherwise,

 

does not apply to any of the following:

 

     (a) Foreign vessels temporarily using waters subject to state

 

jurisdiction.

 

     (b) Military or public vessels of the United States, except

 

recreational-type public vessels.

 

     (c) A vessel whose owner is a state or political subdivision

 


of a state, other than this state and its political subdivisions,

 

that is used principally for governmental purposes and that is

 

clearly identifiable as such.

 

     (d) A ship's lifeboat.

 

     (3) This part does not apply to the landing, operation, and

 

take-off of seaplanes on and from waters subject to the

 

jurisdiction of this state, to the extent that the activity is

 

regulated by rules promulgated under the aeronautics code of the

 

state of Michigan, 1945 PA 327, MCL 259.1 to 259.208.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 626                                    

 

          of the 99th Legislature is enacted into law.
