ENROLLED SENATE BILL No. 699
AN ACT to amend 1961 PA 236, entitled “An act to revise and consolidate the statutes relating to the organization and jurisdiction of the courts of this state; the powers and duties of the courts, and of the judges and other officers of the courts; the forms and attributes of civil claims and actions; the time within which civil actions and proceedings may be brought in the courts; pleading, evidence, practice, and procedure in civil and criminal actions and proceedings in the courts; to provide for the powers and duties of certain state governmental officers and entities; to provide remedies and penalties for the violation of certain provisions of this act; to repeal all acts and parts of acts inconsistent with or contravening any of the provisions of this act; and to repeal acts and parts of acts,” by amending section 874 (MCL 600.874).
The People of the State of Michigan enact:
Sec. 874. (1) The probate court shall charge and collect the following fees:
(a) For performing a marriage ceremony, $10.00.
(b) For issuance of a commission to take testimony, $7.00.
(c) For taking, certifying, sealing, and forwarding depositions, $5.00, and 10 cents per page, which fees shall be considered as costs in the case; and for each copy of the deposition furnished, 3 cents per page.
(2) A probate judge may waive the fee for performing a marriage ceremony if the parties to the marriage are indigent.
(3) A fee paid under subsection (1)(a) shall be remitted to the probate court for the county in which the probate judge performing the marriage serves.
Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 698 of the 96th Legislature is enacted into law.
This act is ordered to take immediate effect.
