Substitute For

SENATE BILL NO. 812

A bill to amend 1978 PA 368, entitled

"Public health code,"

by amending section 20199 (MCL 333.20199) and by adding part 216A.

the people of the state of michigan enact:

Sec. 20199. (1) Except as otherwise provided in subsection (2) or section 20142, this article, a person who violates this article or a rule promulgated or an order issued under this article is guilty of a misdemeanor, punishable by a fine of not more than $1,000.00 for each day the violation continues or, in case of for a violation of sections 20551 to 20554, a fine of not more than $1,000.00 for each occurrence.

(2) A person who violates sections 20181 to 20184 is guilty of a misdemeanor , punishable by imprisonment for not more than 6 months , or a fine of not more than $2,000.00, or both.

PART 216A. SPECIALIZED LABORATORIES

Sec. 21651. (1) As used in this part:

(a) "Interventional kidney access laboratory" means a facility, other than a hospital or freestanding surgical outpatient facility, in which interventional diagnostic and therapeutic procedures for kidney disease and cardiovascular disease are performed on patients on an ambulatory basis. Interventional kidney access laboratory does not include a facility that provides dialysis treatment, maintenance, or training to patients or patient caregivers on an ambulatory or home-care basis.

(b) "Interventional pain management laboratory" means a facility, other than a hospital or freestanding surgical outpatient facility, in which interventional diagnostic and therapeutic procedures for pain management and cardiovascular disease are performed on patients on an ambulatory basis.

(c) "Interventional vascular laboratory" means a facility, other than a hospital or freestanding surgical outpatient facility, in which interventional diagnostic and therapeutic procedures for vascular disease, kidney disease, arterial disease, and vein disease are performed on patients on an ambulatory basis. Interventional vascular laboratory does not include a facility that provides dialysis treatment, maintenance, or training to patients or patient caregivers on an ambulatory or home-care basis.

(d) "Specialized laboratory" means an interventional kidney access laboratory, interventional pain management laboratory, or interventional vascular laboratory.

(2) In addition, article 1 contains general definitions and principles of construction applicable to all articles in this code and part 201 contains definitions applicable to this part.

Sec. 21653. (1) Beginning 180 days after the effective date of the amendatory act that added this section, a person that establishes or operates a specialized laboratory shall register the specialized laboratory with the department of health and human services on a form and in a manner required by the department of health and human services.

(2) On the receipt of an application and payment of a $250.00 registration fee, the department of health and human services shall register a specialized laboratory under this part. A registration is valid for 1 year and may be renewed on application and payment of the fee described in this subsection.

Sec. 21655. Both of the following apply to a person that violates this part:

(a) The person is subject to an administrative fine of $100.00 for each day that the violation continues. The department of health and human services shall provide notice and an opportunity for a hearing in the same manner as provided in section 20166.

(b) The person is guilty of a misdemeanor punishable by a fine of not more than $5,000.00.
