SENATE BILL No. 882

A bill to amend 1970 PA 91, entitled
"Child custody act of 1970,"
(MCL 722.21 to 722.31) by adding section 7d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 7d. (1) If a noncustodial parent who has been granted
parenting time under this act is on active duty outside of this
state, that parent may petition the court to allow his or her
family member to fulfill his or her parenting time as ordered by
the court.
(2) If a petition is filed under subsection (1), the court may
enter a temporary order allowing the noncustodial parent who is on
active duty outside of this state to assign his or her parenting
time to his or her family member if there is clear and convincing
evidence that it is in the best interest of the child to do so.
Upon the noncustodial parent's return to this state, the court
shall reinstate the parenting time order in effect immediately
preceding the period of active duty served outside of this state.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
