SENATE BILL NO. 914

ANANICH and MCMORROW and referred to the Committee on Finance.
A bill to amend 1961 PA 236, entitled
"Revised judicature act of 1961,"
(MCL 600.101 to 600.9947) by adding sections 3102, 3202, 5740, and 5782.
the people of the state of michigan enact:
Sec. 3102. A court shall not enter a
judgment for sale under this chapter or take any action to advance an action
filed under this chapter if prohibited under the emergency rental relief act.
Sec. 3202. (1) A person foreclosing or
entitled to foreclose a mortgage under this chapter shall not take any action
to proceed with the foreclosure, or instruct or allow any other person to do
so, if prohibited by the emergency rental relief act.
(2)
A person aggrieved by a violation of this section may commence an action to
restrain the violation and recover any costs or expenses incurred because of
the violation and the actual costs of the action, including, but not limited
to, attorney fees.
Sec. 5740. A court shall not advance
summary proceedings, enter a judgment for possession, or issue a writ of
restitution or order for eviction under this chapter if prohibited under the
emergency rental relief act.
Sec. 5782. A court shall not advance an action, enter
a judgment for possession, or issue a writ of restitution or order for eviction
after entry of a judgment under this chapter if prohibited under the emergency
rental relief act.
Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 912 of the 100th Legislature is enacted into law.
