SUBSTITUTE FOR

 

SENATE BILL NO. 943

 

 

 

 

 

 

 

 

 

     A bill to amend 1953 PA 232, entitled

 

"Corrections code of 1953,"

 

(MCL 791.201 to 791.285) by adding section 84.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 84. (1) On a quarterly basis, each field operations

 

administration region shall provide to the department of health and

 

human services a list of supervised individuals within that region

 

who have absconded from supervision and whom a law enforcement

 

agency is actively seeking.

 

     (2) As used in this section:

 

     (a) "Abscond" means that an individual supervised under this

 

act intentionally fails to report to his or her supervising agent

 

and intentionally fails to advise his or her supervising agent of

 

his or her whereabouts.

 

     (b) "Actively seeking" means either of the following:

 

     (i) A law enforcement agency intends to enforce an outstanding


felony warrant for a supervised individual or arrest a supervised

 

individual for a parole violation or for absconding from

 

supervision within the following 30 days.

 

     (ii) The supervised individual has an active warrant for 1 of

 

the following National Crime Information Center categories:

 

     (A) Escape.

 

     (B) Flight to avoid.

 

     (C) Flight and escape.

 

     (c) "Field operations administration region" means 1 of the

 

geographic regions delineated by the department that are charged

 

with the responsibility of overseeing supervised individuals within

 

the region, including individuals on probation and individuals

 

released from prison on parole, and that employ parole and

 

probation agents to engage in direct supervision of the supervised

 

individuals.

 

     (d) "Supervised individual" means an individual who has been

 

released from prison on parole.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 944 of the 98th Legislature is enacted into

 

law.
