A bill to amend 2006 PA 110, entitled
"Michigan zoning enabling act,"
(MCL 125.3101 to 125.3702) by adding section 205c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 205c. (1) Public school property used for a public school
purpose shall be considered unzoned property and is exempt from a
zoning ordinance adopted under this act. This subsection does not
exempt the property from applicable review for informational
purposes under section 1263 of the revised school code, 1976 PA
451, MCL 380.1263.
(2) As used in this section:
(a) "Public school property" means property owned or leased by
either or both of the following:
(i) The governing board of a public school.
(ii) A foundation owned or managed by the governing board of a
public school.
(b) "Public school purpose" means a purpose that provides a
benefit, including, but not limited to, a commercial or financial
benefit, to a public school, the governing board of a public
school, or a foundation owned or managed by the governing board of
a public school.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
