SENATE BILL NO. 1006

April 14, 2022, Introduced by Senators HORN and MOSS and referred to the Committee on Economic and Small Business Development.

A bill to amend 1998 PA 58, entitled

"Michigan liquor control code of 1998,"

(MCL 436.1101 to 436.2303) by adding section 548.

the people of the state of michigan enact:

Sec. 548. (1) The commission may issue an on-premises public swimming pool permit to an on-premises licensee that operates a public swimming pool. The commission shall charge a fee for an on-premises public swimming pool permit of $350.00. An on-premises public swimming pool permit issued under this section is not transferrable.

(2) A holder of an on-premises public swimming pool permit may sell and serve alcoholic liquor in a public swimming pool located on the licensed premises if all of the following conditions are met:

(a) The holder of the on-premises public swimming pool permit complies with section 12526a of the public health code, 1978 PA 368, MCL 333.12526a.

(b) The sales performed under the on-premises public swimming pool permit are limited to an exclusive area that is well defined and clearly marked. The exclusive area under this subdivision must not be accessible to minors.

(c) The sales are conducted by employees of the holder of the on-premises public swimming pool permit who have completed a server training program as provided for in section 906 and the rules promulgated by the commission.

(3) The commission shall develop an application for an annual on-premises public swimming pool permit allowing for licensed activities under this section.

(4) As used in this section, "public swimming pool" means that term as defined in section 12521 of the public health code, 1978 PA 368, MCL 333.12521.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 1007 of the 101st Legislature is enacted into law.
