SENATE JOINT RESOLUTION K

June 26, 2024, Introduced by Senators LINDSEY and RUNESTAD and referred to the Committee on Civil Rights, Judiciary, and Public Safety.

A joint resolution proposing an amendment to the state constitution of 1963, by amending section 46 of article IV, to allow for the death penalty in certain cases.

Resolved by the Senate and House of Representatives of the state of Michigan, That the following amendment to the state constitution of 1963, to allow for the death penalty in certain cases, is proposed, agreed to, and submitted to the people of the state:

article IV

Sec. 46. (1) No Except as otherwise provided in this section, no law shall be enacted providing for the penalty of death.

(2) The legislature may enact a law that provides for the penalty of death for a sexual crime committed against a victim who is less than 18 years of age.

Resolved further, That the foregoing amendment shall be submitted to the people of the state at the next general election in the manner provided by law.
