1.1A bill for an act
1.2relating to families; modifying distribution of child support federal tax offset;
1.3amending Minnesota Statutes 2012, section 256.741, subdivision 2a.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 256.741, subdivision 2a, is amended to read:
1.6    Subd. 2a. Distribution of child support. (a) The state shall distribute current child
1.7support and maintenance received by the state to an individual who assigns the right to
1.8that support under subdivision 2, paragraph (a).
1.9    (b) When the public authority collects child support arrearages on behalf of an
1.10individual who is receiving public assistance, the public authority shall first apply the
1.11collection to satisfy those arrears that are permanently assigned to the state.
1.12    (c) When the public authority collects child support arrearages on behalf of an
1.13individual who is not receiving public assistance, the public authority shall first apply the
1.14collection to satisfy those arrears that are not permanently assigned to the state.
1.15    (d) When the public authority collects child support arrearages certified under
1.16the federal tax offset, the public authority shall first apply distribute the collection in
1.17the following priority: first to satisfy current support, then to those arrears that are not
1.18permanently assigned to the state, and then to those arrears that are permanently assigned
1.19to the state.
