1.1A bill for an act
1.2relating to state government; increasing the membership of the Legislative
1.3Commission on Pensions and Retirement; amending Minnesota Statutes 2010,
1.4section 3.85, subdivision 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 3.85, subdivision 3, is amended to read:
1.7    Subd. 3. Membership. The commission consists of five seven members of the
1.8senate appointed by the Subcommittee on Committees of the Committee on Rules and
1.9Administration and five seven members of the house of representatives appointed by
1.10the speaker. No more than five members from each chamber may be from the majority
1.11caucus in that chamber. Members shall be appointed at the commencement of each regular
1.12session of the legislature for a two-year term beginning January 16 of the first year of the
1.13regular session. Members continue to serve until their successors are appointed. Vacancies
1.14that occur while the legislature is in session shall be filled like regular appointments. If the
1.15legislature is not in session, senate vacancies shall be filled by the last Subcommittee on
1.16Committees of the senate Committee on Rules and Administration or other appointing
1.17authority designated by the senate rules, and house of representatives vacancies shall be
1.18filled by the last speaker of the house, or if the speaker is not available, by the last chair of
1.19the house of representatives Rules Committee.
1.20EFFECTIVE DATE.This section is effective the day following final enactment.
1.21Within ten days of the effective date of this section, the appointing authorities must
1.22appoint additional members to the commission, as required by this section.
