1.1A bill for an act
1.2relating to human services; establishing a hybrid nursing home and assisted
1.3living pilot project; appropriating money.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. NURSING FACILITY PILOT PROJECT.
1.6    Subdivision 1. Report. The commissioner of human services, in consultation with
1.7the commissioner of health, stakeholders, and experts, shall provide to the legislature
1.8recommendations by November 15, 2011, on how to develop a project to demonstrate a
1.9new approach to caring for certain individuals in nursing facilities.
1.10    Subd. 2. Contents of report. The recommendations shall address the:
1.11(1) nature of the demonstration in terms of timing, size, qualifications to participate,
1.12participation selection criteria and postdemonstration options for the demonstration and
1.13for participating facilities;
1.14(2) nature of needed new form of licensure;
1.15(3) characteristics of the individuals the new model is intended to serve and
1.16comparison of these characteristics with those individuals served by existing models of
1.17care;
1.18(4) quality standards for licensure addressing management, types and amounts of
1.19staffing, safety, infection control, care processes, quality improvement, and resident rights;
1.20(5) characteristics of inspection process;
1.21(6) funding for inspection process;
1.22(7) enforcement authorities;
1.23(8) role of Medicare;
1.24(9) participation in the elderly waiver program, including rate setting;
2.1(10) nature of any federal approval or waiver requirements and the method and
2.2timing of obtaining them;
2.3(11) consumer rights; and
2.4(12) methods and resources needed to evaluate the effectiveness of the model with
2.5regards to cost and quality.

2.6    Sec. 2. APPROPRIATION.
2.7$20,000 is appropriated during fiscal year 2012 from the general fund to the
2.8commissioner of human services for the preparation of this report.
