1.1A bill for an act
1.2relating to human services; enacting Gager's Law; adopting standards that govern
1.3outdoor activity at licensed child care facilities;proposing coding for new law
1.4in Minnesota Statutes, chapter 245A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. CITATION.
1.7This act may be cited as "Gager's Law."

1.8    Sec. 2. [245A.147] GUIDELINES GOVERNING OUTDOOR ACTIVITY.
1.9(a) All licensed child care providers must not allow children to engage in outdoor
1.10activities if:
1.11(1) the temperature is below 20 degrees without wind chill factor;
1.12(2) the heat index is 100 degrees or above; or
1.13(3) there is an air quality warning issued by local weather stations.
1.14(b) In addition to the guidelines in paragraph (a), all licensed child care providers
1.15shall ensure that each child engaging in outdoor activities is dressed in weather-appropriate
1.16clothing that maintains a comfortable body temperature. During the winter, if a child
1.17engages in outdoor activity, the child must be dressed in weather-appropriate clothing
1.18including, but not limited to, mittens or gloves, hat, jacket, and boots.
