1.2relating to environment; modifying Waste Management Act;amending
1.3Minnesota Statutes 2010, sections 115A.03, subdivision 25a; 115A.95.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 115A.03, subdivision 25a, is amended to
1.6read:
1.7 Subd. 25a. Recyclable materials. "Recyclable materials" means materials that are
1.8separated from mixed municipal solid waste for the purpose of recycling or composting,
1.9including paper, glass, plastics, metals, automobile oil,and batteries, and source-separated
1.10compostable materials. Refuse-derived fuel or other material that is destroyed by
1.11incineration is not a recyclable material.
1.12 Sec. 2. Minnesota Statutes 2010, section 115A.95, is amended to read:
1.13115A.95 RECYCLABLE MATERIALS.
1.14(a) Recyclable materials must be delivered to the appropriate materials processing
1.15facility as outlined in Minnesota Rules, parts 7035.2836 and 7035.2845, or any other
1.16facility permitted to recycle or compost the materials.
1.17(b) A disposal facility or a resource recovery facility that is composting mixed
1.18municipal solid waste, burning waste, or converting waste to energy or to materials for
1.19combustion may not accept source-separated recyclable materials, and a solid waste
1.20collector or transporter may not deliver source-separated recyclable materials to such a
1.21facility, except for recycling or transfer to a recycler, unless the commissioner determines
1.22that no other person is willing to accept the recyclable materials.
