1.1A bill for an act
1.2relating to public safety; providing health care to survivors of peace officers or
1.3firefighters killed in line of duty;amending Minnesota Statutes 2010, section
1.4299A.465, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 299A.465, subdivision 2, is amended to
1.7read:
1.8    Subd. 2. Officer or firefighter killed in line of duty. (a) This subdivision applies
1.9when a peace officer or firefighter is killed while on duty and discharging the officer's or
1.10firefighter's duties as a peace officer or firefighter.
1.11(b) The officer's or firefighter's employer shall continue to cover provide health
1.12insurance coverage, at least equal to the employee coverage available to the officer
1.13or firefighter at the time of death, to the deceased officer's or firefighter's dependents,
1.14including the officer's or firefighter's spouse:
1.15(1) if the officer or firefighter was receiving dependent coverage at the time of the
1.16officer's or firefighter's death under the employer's group health plan; or
1.17(2) if the officer's or firefighter's spouse was not covered as a dependent at the time
1.18of the officer's or firefighter's death, but at that time was eligible, or afterward becomes
1.19eligible, to be a dependent on the employer's group health plan.
1.20(c) The employer is responsible for the employer's contribution for the coverage of
1.21the officer's or firefighter's dependents. cost of the insurance coverage and the coverage
1.22must continue for a dependent of the officer or firefighter for the period of time that the
1.23person is a dependent up to the age of 65.
