1.1A bill for an act
1.2relating to energy; requiring that cost of service be the primary factor used to
1.3determine revenue allocation between customer classes;amending Minnesota
1.4Statutes 2012, section 216B.16, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 216B.16, is amended by adding a
1.7subdivision to read:
1.8    Subd. 6e. Revenue allocation among customer classes. Cost of service shall
1.9be the primary consideration when the commission determines revenue allocation
1.10among customer classes. Factors other than cost of service may also be considered and
1.11evaluated by the commission when it determines revenue allocations. Revenue allocation
1.12among customer classes that deviates from the cost of service must be supported by a
1.13preponderance of the evidence.
1.14EFFECTIVE DATE.The section is effective the day following final enactment and
1.15applies to filings for rate changes filed on or after that date.
