1.2relating to data practices; modifying provisions related to legislative and budget

1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2012, section 13.605, subdivision 1, is amended to read:
1.6 Subdivision 1. Legislative and budget proposal data.(a) Definition. As used
1.7in this section, "state administration" means the governor's office, the Department of
1.8Management and Budget, and any state agency that is under the direct control of the
1.9governor.
1.10(b) Classifications. Except as provided in this subdivision, legislative and budget
1.11proposals, including preliminary drafts, that are created, collected, or maintained bythe
1.12state administration a state agency are protected nonpublic data. After the a legislative
1.13or budget proposal is presented to the legislature by thestate administration agency,
1.14or introduced in bill form, supporting data, including agency requests, are public data.
1.15Supporting data do not include preliminary drafts. The stateadministration agency may
1.16disclose any of the datawithin the state administration and to the public to another agency
1.17or to the public at any time if disclosure would aid theadministration agency in considering
1.18and preparing its proposals. Unless the data are related to a legislative or budget proposal
1.19under consideration at a current or reasonably anticipated special session of the legislature,
1.20preliminary drafts created during the prior 12 months become public on July 1 of each year.
