1.1A bill for an act
1.2relating to privacy; requiring owner's permission before a portable wireless
1.3device can collect location information in Minnesota;proposing coding for new
1.4law in Minnesota Statutes, chapter 325F.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [325F.705] COLLECTION OF LOCATION INFORMATION BY
1.7PORTABLE WIRELESS DEVICES.
1.8No portable wireless device may transmit information regarding the location of the
1.9device in Minnesota to any person other than a law enforcement agency operating under
1.10section 237.83 without written permission from the owner of the device.
1.11For the purposes of this section, "portable wireless device" means a device weighing
1.12less than three pounds that transmits two-way voice or data over radio waves.
1.13EFFECTIVE DATE.This section is effective September 1, 2011.
