1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [16A.89] CONTINUATION OF REVENUE-PRODUCING STATE
1.7GOVERNMENT PROGRAMS DURING A GOVERNMENT SHUTDOWN.
1.8 Subdivision 1. Government shutdown. A government shutdown is a period on
1.9and after July 1 of an odd-numbered year, in which one or more of the bills making
1.10appropriations for the following areas have not been enacted: higher education, education,
1.11agriculture, environment and natural resources, health and human services, state
1.12government, jobs and economic development, transportation, judiciary, public safety, and
1.13aids and credits to local government. This section does not require appropriations bills to
1.14be organized in the manner specified in this section.
1.15 Subd. 2. Continuation of revenue-producing programs. During a government
1.16shutdown as described in subdivision 1, a state agency shall continue any program that
1.17generates revenue. Those revenue-producing programs must be kept operational and fully
1.18funded to maintain the program operation.
1.19 Subd. 3. Funding. The funding necessary to continue the operation of a
1.20revenue-producing program is appropriated from the fund in the state treasury that is
1.21used to carry on the operation of the state revenue-producing program in the amount
1.22last enacted and signed into law.
