1.1A bill for an act
1.2relating to public safety; drivers' licenses; eliminating placement of residence
1.3addresses on drivers' licenses; eliminating the fee charged to change the residence
1.4address on a driver's license record; establishing a computerized records system;
1.5authorizing Internet access; specifying system access requirements;amending
1.6Minnesota Statutes 2012, sections 171.07, subdivisions 1, 3; 171.11; 171.12, by
1.7adding a subdivision; 171.121.
1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.9    Section 1. Minnesota Statutes 2012, section 171.07, subdivision 1, is amended to read:
1.10    Subdivision 1. License; contents. (a) Upon the payment of the required fee, the
1.11department shall issue to every qualifying applicant a license designating the type or
1.12class of vehicles the applicant is authorized to drive as applied for. This license must
1.13bear a distinguishing number assigned to the licensee; the licensee's full name and date
1.14of birth; either (1) the licensee's residence address, or (2) the designated address under
1.15section 5B.05; a description of the licensee in a manner as the commissioner deems
1.16necessary; and the usual signature of the licensee. No license is valid unless it bears
1.17the usual signature of the licensee. Every license must bear a colored photograph or an
1.18electronically produced image of the licensee.
1.19    (b) If the United States Postal Service will not deliver mail to the applicant's
1.20residence address as listed on the license, then the applicant shall provide verification from
1.21the United States Postal Service that mail will not be delivered to the applicant's residence
1.22address and that mail will be delivered to a specified alternate mailing address. When an
1.23applicant provides an alternate mailing address under this subdivision, the commissioner
1.24shall use the alternate mailing address in lieu of the applicant's residence address for
1.25all notices and mailings to the applicant.
2.1    (c) Every license issued to an applicant under the age of 21 must be of a
2.2distinguishing color and plainly marked "Under-21."
2.3    (d) The department shall use processes in issuing a license that prohibit, as nearly as
2.4possible, the ability to alter or reproduce a license, or prohibit the ability to superimpose a
2.5photograph or electronically produced image on a license, without ready detection.
2.6    (e) A license issued to an applicant age 65 or over must be plainly marked "senior" if
2.7requested by the applicant.

2.8    Sec. 2. Minnesota Statutes 2012, section 171.07, subdivision 3, is amended to read:
2.9    Subd. 3. Identification card; fee. (a) Upon payment of the required fee, the
2.10department shall issue to every qualifying applicant a Minnesota identification card. The
2.11department may not issue a Minnesota identification card to an individual who has a
2.12driver's license, other than a limited license. The department may not issue an enhanced
2.13identification card to an individual who is under 16 years of age, not a resident of this state,
2.14or not a citizen of the United States of America. The card must bear a distinguishing number
2.15assigned to the applicant; a colored photograph or an electronically produced image of the
2.16applicant; the applicant's full name and date of birth; either (1) the licensee's residence
2.17address, or (2) the designated address under section 5B.05; a description of the applicant in
2.18the manner as the commissioner deems necessary; and the usual signature of the applicant.
2.19    (b) If the United States Postal Service will not deliver mail to the applicant's
2.20residence address as listed on the Minnesota identification card, then the applicant shall
2.21provide verification from the United States Postal Service that mail will not be delivered
2.22to the applicant's residence address and that mail will be delivered to a specified alternate
2.23mailing address. When an applicant provides an alternate mailing address under this
2.24subdivision, the commissioner shall use the alternate mailing address in lieu of the
2.25applicant's residence address for all notices and mailings to the applicant.
2.26    (c) Each identification card issued to an applicant under the age of 21 must be of a
2.27distinguishing color and plainly marked "Under-21."
2.28    (d) Each Minnesota identification card must be plainly marked "Minnesota
2.29identification card - not a driver's license."
2.30    (e) The fee for a Minnesota identification card is 50 cents when issued to a person
2.31who is developmentally disabled, as defined in section 252A.02, subdivision 2; a
2.32physically disabled person, as defined in section 169.345, subdivision 2; or, a person with
2.33mental illness, as described in section 245.462, subdivision 20, paragraph (c).

3.1    Sec. 3. Minnesota Statutes 2012, section 171.11, is amended to read:
3.2171.11 DUPLICATE LICENSE; CHANGE OF DOMICILE OR NAME.
3.3When any person, after applying for or receiving a driver's license, shall change
3.4permanent domicile from the address named in such application or in the license issued to
3.5the person, or shall change a name by marriage or otherwise, such person shall, within
3.630 days thereafter, apply for a duplicate driver's license upon a form furnished by the
3.7department and pay the required fee or using the computerized records system under section
3.8171.12, subdivision 1a. The application or duplicate license shall show both the licensee's
3.9old address and new address or the former name and new name as the case may be.

3.10    Sec. 4. Minnesota Statutes 2012, section 171.12, is amended by adding a subdivision
3.11to read:
3.12    Subd. 1a. Computerized records system; access to address information. (a) The
3.13department shall maintain a computerized records system of the residence address or
3.14designated address for all driver's license and identification card applicants.
3.15(b) The record shall be Internet accessible by applicants, who may use the system to
3.16change the residence address or designated address of record associated with the applicant's
3.17driver's license or identification card. In order to access the system, the applicant must
3.18provide the applicant's driver's license number or identification card number, birth date,
3.19and any other security code or measure the department deems appropriate.
3.20(c) Subdivision 7 applies to the data maintained in the computerized records system
3.21under paragraph (a).

3.22    Sec. 5. Minnesota Statutes 2012, section 171.121, is amended to read:
3.23171.121 USE OF ANOTHER'S RESIDENCE ADDRESS.
3.24A person may notify the commissioner in writing to the effect that the person (1) is
3.25the owner of a residence, and (2) does not consent to have that residence address identified
3.26on any driver's license or identification card or driving record of the department as the
3.27residence address or permanent mailing address of any person named in the notice. The
3.28notice may not name a spouse of the notifying person. Upon receiving the notice the
3.29commissioner shall not issue any license or identification card under this chapter, or
3.30accept an application for a license or identification card under this chapter, that lists the
3.31residence address identified in the notice as the residence address or permanent mailing
3.32address of any person named in the notice.
