1.2relating to local government; authorizing the city of North Branch to increase its
1.3Public Utilities Commission from three to up to seven members.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. NORTH BRANCH PUBLIC UTILITIES COMMISSION
1.6MEMBERSHIP.
1.7(a) Notwithstanding Minnesota Statutes, section 412.341, subdivision 1, the city
1.8of North Branch may by ordinance increase the membership of the city's Public Utilities
1.9Commission to a maximum of seven members. The ordinance must provide for staggered
1.10terms for the commission members. The ordinance may provide that residency within the
1.11city is not a qualification for serving on the commission and permit up to two members of
1.12the city council to serve on the commission.
1.13(b) The provisions of Minnesota Statutes, sections 412.331 to 412.391, that do not
1.14conflict with paragraph (a) apply to the additional members to the same extent that they
1.15apply to the other members of the commission.
1.16EFFECTIVE DATE.This section is effective the day after the governing body of
1.17the city of North Branch and its chief clerical officer timely complete their compliance
1.18with Minnesota Statutes, section 645.021, subdivisions 2 and 3.
