1.1A bill for an act
1.2relating to higher education; regulating travel abroad study programs used for
1.3postsecondary education credit;proposing coding for new law in Minnesota
1.4Statutes, chapter 136A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [136A.89] STUDY ABROAD PROGRAM; REPORTING
1.7REQUIREMENTS.
1.8    Subdivision 1. Definitions. (a) For purposes of this section, the terms defined in this
1.9subdivision have the meanings given them.
1.10(b) "Postsecondary institution" means an institution that meets the eligibility
1.11requirements under section 136A.103 to participate in state financial aid programs.
1.12(c) "Program" means a study abroad program in which program participants travel
1.13outside of the United States in connection with an educational experience.
1.14    Subd. 2. Report required to offer credit for study abroad program. A program
1.15may not be offered for credit at a postsecondary institution unless the organizer of the
1.16program has complied with the reporting requirements of subdivision 3.
1.17    Subd. 3. Report. (a) A program organizer must file by June 1 of each year a report
1.18to the office with the following information from the previous calendar year:
1.19(1) deaths of program participants resulting during program participation;
1.20(2) accidents and illnesses occurring during program participation that resulted
1.21in hospitalization;
1.22(3) sexual assaults against program participants occurring during program
1.23participation; and
2.1(4) incidents, including incidents reported under clause (3), involving program
2.2participants during the program that resulted in known calls with police involvement
2.3or an incident resulting in a police report.
2.4(b) If a program organizer fails to file an annual report with the office by June 1, the
2.5program is prohibited from offering the study abroad program for credit in the following
2.6calendar year.
2.7(c) The office must publish the report information by program on its Web site in
2.8a format that facilitates identifying information for a particular program. A program
2.9organizer must include in its written materials provided to prospective program
2.10participants a link to the office Web site stating that program health and safety information
2.11is available at the Web site.
2.12EFFECTIVE DATE.This section is effective the day following final enactment.
2.13Initial reports required by this section must be filed by June 1, 2015.
