1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [62Q.026] CERTAIN FEDERALLY NONQUALIFIED HEALTH
1.7PLANS; SALE PERMITTED.
1.8 Subdivision 1. Definitions. (a) For purposes of this section, the terms defined
1.9in this section have the meanings given.
1.10(b) "Commissioner" means the commissioner of commerce.
1.11(c) "Health plan" has the meaning given in section 62Q.01, subdivision 3.
1.12(d) "Health plan company" has the meaning given in section 62Q.01, subdivision 4.
1.13(e) "Nonqualified health plan" means any health plan not certified by the federal
1.14secretary of health and human services in accordance with the Patient Protection and
1.15Affordable Care Act of 2010, as amended.
1.16(f) "Qualified health plan" means a health plan certified by the federal secretary of
1.17health and human services for eligibility to be sold inside health benefit exchanges in
1.18accordance with the Patient Protection and Affordable Care Act of 2010, as amended.
1.19 Subd. 2. Sale of nonqualified health plan permitted. A health plan company
1.20authorized under Minnesota law to offer, issue, sell, or renew a health plan in Minnesota
1.21may do so regardless of whether the health plan is a qualified or nonqualified health plan
1.22under the federal Patient Protection and Affordable Care Act of 2010, as amended. No
1.23statute or rule of this state shall be interpreted as providing to the contrary.
2.1 Subd. 3. Limitation. This section must not be used to authorize, establish, or
2.2operate a health insurance exchange.
2.3EFFECTIVE DATE.This section is effective the day following final enactment.
